About the Author


Dr. Robert J. McWhirter received his Juris Doctorate from Arizona State University College of Law in 1988.  Upon graduation, Mr. McWhirter clerked for Vice Chief Justice Stanley G. Feldman of the Supreme Court of Arizona.  Bob McWhirter

Mr. McWhirter was an Assistant Federal Public Defender from 1989 until 2007 representing Native Americans and other clients in a broad range of Federal cases including homicide, sexual abuse, and bank robbery.  In addition, Mr. McWhirter specializes in criminal immigration law publishing articles in the GEORGETOWN IMMIGRATION LAW REVIEW and the CRIMINAL PRACTICE LAW REPORT and two books, THE CRIMINAL LAWYER’S GUIDE TO IMMIGRATION LAW: QUESTIONS AND ANSWERS, 2nd Ed. (ABA Books 2006) and THE CITIZENSHIP FLOWCHART (ABA Books 2007).  In 2010, the United States Supreme Court, through Justice Alito’s concurring opinion, extensively quoted from Mr. McWhirter’s THE CRIMINAL LAWYER’S GUIDE TO IMMIGRATION LAW, in the ground breaking case of Padilla v. Kentucky.

Mr. McWhirter also served from 2007-2010 as a Senior Attorney with the Maricopa Legal Defender’s Office defending death penalty and other serious felonies.  

Mr. McWhirter has been an adjunct professor in Trial Advocacy at the Phoenix School of Law as well as a visiting professor of law at the Catholic University of Chile and the University of Chile.  Mr. McWhirter has taught trial advocacy and criminal procedure in Venezuela, Mexico, Ecuador, Nicaragua, Colombia, and Chile.   He also served as an advisor to the Venezuelan Constitutional Assembly drafting the 1999 Venezuelan Constitution as a grant recipient from the United States State Department. 

Mr. McWhirter has served on the American Bar Association Criminal Justice Section Council and on the Standards Committee writing the ABA CRIMINAL JUSTICE STANDARDS.  Mr. McWhirter is a past president of Arizona Attorneys for Criminal Justice. He has served on the corporate board of directors of Catholic Social Charities of Arizona.  He is a past president of the St. Thomas More Society of Phoenix Arizona and a recipient of its St. Thomas More Award.  

But Mr. McWhirter’s best achievement is that he is the father of three great boys.
